NRC Submits Report to Congress on Licensing Frameworks for Fusion Energy Machines

In July 2025, the U.S. Nuclear Regulatory Commission (NRC) submitted a new report to Congress on how the Commission can support licensing mass-manufactured fusion machines. The report was required by Section 205(c)(2) of the ADVANCE Act. The ADVANCE Act, signed into law on July 9, 2024, codified fusion-specific regulations in the US and streamlines the deployment of fusion. Section 205 of the Act tasked the NRC with studying how the agency could develop a regulatory framework for mass-manufactured fusion machines.

US Senate Passes ADVANCE Act, Including Legislation to Codify US Fusion Regulations

On June 18, in a bipartisan vote, the Senate passed the ADVANCE Act, including legislation that will codify fusion energy regulations separate from nuclear fission. The Bill is now headed to the President’s desk for signature; once signed into law, the United States will be the second country to enact specific fusion regulations into law – following the United Kingdom’s enactment of fusion regulatory legislation in October 2023.

On October 11, 2023, the U.S. Nuclear Regulatory Commission (NRC) held the first of a series of three public meetings to share the staff’s progress and seek public input on the preliminary proposed rule language, preliminary draft guidance (NUREG-1556, Volume 22), and specific topics of the proposed rule that would form the regulatory framework under 10 CFR Part 30 for fusion systems.
